These Terms of Use (“Terms”) govern your access to and use of all content, artwork, products, and services available on the website https://kiki-kirk.art (“the Service”), operated by Christine Kirk (“we”, “us”, “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Service.
Intellectual Property
All artwork, images, text, branding, and digital content on the Service are protected by copyright and other intellectual property laws.
Nothing in these Terms transfers any intellectual property rights from us to you. All rights remain solely with Christine Kirk and her licensors.
COPYRIGHT OWNERSHIP
Artist Copyright
Christine Kirk retains full copyright and all intellectual property rights to every artwork she creates, whether original or commissioned.
Customer Rights
When you purchase a physical artwork, you receive the physical item only, not the copyright. You may display the artwork privately, but you may not:
- Reproduce it
- Create prints
- Sell copies
- Use it commercially
- Create derivative works
- Upload it to any platform for automated analysis or reproduction
unless you obtain written permission from the artist.
Prohibited Uses (AI, Machine Learning & Automated Systems)
To protect the artist’s creative work, the following uses are strictly prohibited:
- Uploading any artwork by Christine Kirk to AI training datasets
- Using the artwork for machine learning, neural network training, or model fine‑tuning
- Submitting the artwork to image‑generation systems (e.g., style transfer, image‑to‑image, diffusion models)
- Uploading the artwork to any AI platform for analysis, reconstruction, or derivative creation
- Scraping, harvesting, or automated downloading of images from the website
Any such use constitutes copyright infringement under UK law and international treaties (including the Berne Convention).
USER Accounts
If you create an account on the Service, you agree to:
- Provide accurate information
- Maintain the security of your login credentials
- Notify us immediately of any unauthorised access
You are responsible for all activity under your account.
Third-Party Services
The Service may include links or integrations with third‑party websites, applications, or services.
You acknowledge that:
- Use of third‑party services is at your own risk
- We are not responsible for third‑party content, privacy practices, or actions
- We are not liable for any loss or damage arising from your use of third‑party services
We encourage you to review the terms and privacy policies of any third‑party websites you visit.
Sales, Commissions & Payments
If you purchase artwork or commission a piece:
- Prices are listed in GBP
- Payment terms will be clearly stated at checkout or during commission agreement
- Commissions may require deposits or staged payments
- Ownership transfers only upon full payment
Full details may be provided separately in commission agreements.
Returns & Refunds
As required under UK consumer law:
- Physical artwork may be returned within 14 days of delivery if it is unused and in original condition
- Custom commissions are non‑refundable, as they are bespoke goods created to your specification
- Return shipping costs are the responsibility of the customer unless the item is faulty
A full Returns Policy should be provided separately.
Delivery & Fulfilment
We will provide estimated delivery times at checkout or during commission discussions.
Delays caused by couriers or customs are outside our control.
Disclaimer
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
We disclaim all warranties to the fullest extent permitted by law. However, nothing in these Terms affects your statutory rights under UK consumer law.
Limitation of Liability
To the extent permitted by law, we shall not be liable for:
- Loss of data
- Loss of profits
- Business interruption
- Indirect or consequential damages
Our liability for physical goods is limited to the purchase price paid.
Termination of Contract
We may suspend or terminate your access to the Service, or cancel any contract or commission, if:
- You breach these Terms
- You misuse the artwork or intellectual property
- You fail to make required payments
- You engage in abusive, unlawful, or harmful behaviour
- You provide false or misleading information
If we terminate a commission due to your breach, any deposits paid are non‑refundable, and we may retain or dispose of any work‑in‑progress at our discretion.
If you wish to terminate a commission, you may do so in writing. For bespoke artwork, deposits are non‑refundable once work has begun, in accordance with UK consumer law.
Termination does not affect any rights or obligations that have already accrued, including copyright ownership, payment obligations, and prohibited‑use restrictions.
Dispute Resolution
Before initiating legal proceedings, both parties agree to attempt to resolve any dispute, claim, or disagreement arising out of or relating to these Terms through good‑faith negotiation.
If a resolution cannot be reached within 30 days, either party may pursue legal remedies in accordance with the Governing Law and Jurisdiction section.
Nothing in this clause prevents either party from seeking urgent injunctive relief (e.g., in cases of copyright infringement).
Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales.
Any disputes shall be resolved exclusively in the courts of England and Wales.
International users are responsible for complying with any local laws applicable in their jurisdiction.
Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice on the website or via email at least 15 days before the new Terms take effect.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Survival
Any provisions which by their nature should survive termination — including copyright ownership, prohibited uses, limitation of liability, and governing law — shall continue in full force and effect.
